Maka-Laskas Adventures

Terms & Conditions

Please read these terms carefully before booking. By making a booking, you agree to them on behalf of everyone traveling with you.

1. Booking Acceptance & Confirmation

1.Formation of Contract

A legally binding contract or terms of service agreement between the Client and Maka-Laskas Adventures is formed only when:

  • The Company receives and clears the required deposit or full payment; and
  • The Company issues a written Formal Booking Confirmation (email or official document).

Until both conditions are met, no booking shall be considered confirmed.

2.Acceptance of Terms & Risk

By making a booking, the Client confirms that they have read, understood and agreed to these Terms & Conditions in full. The Client accepts all inherent risks associated with travel, wildlife encounters, and adventure activities, and agrees to comply with all Company policies, safety instructions, and local, national, and international regulations. This acceptance applies to all travelers included in the booking, and the person making the booking assumes responsibility on their behalf.

3.Payment Receipt & Transaction Fees

Payment is deemed received only when funds have successfully cleared and are reflected in the Company’s official designated account.

  1. a)Note: A transfer slip or screenshot is not proof of payment.
  2. b)The Client is responsible for all bank transfer charges or credit card surcharges to ensure the Company receives the full invoiced amount.

  1. a)Final itinerary and booking number
  2. b)Pricing breakdown
  3. c)Travel dates and services included

The Client is responsible for reviewing all of these document details carefully and immediately, and for notifying the Company of any discrepancies. 5.Provisional Bookings & Permit Exceptions

The Company may, at its discretion, hold a provisional reservation for a limited period of 48 to 72 hours without payment. Such reservations are not guaranteed, and they may be automatically released without notice if the deposit is not received within the agreed timeframe. Gorilla and Chimpanzee permits cannot be held provisionally. They require immediate, 100% cleared payment to be secured with the National Wildlife Authorities.

6.Changes by the Client Before Confirmation

The Client may request changes to a booking before confirmation without penalty. Once confirmed, any changes are subject to:

  1. a)Availability
  2. b)Additional costs
  3. c)Third-party supplier terms

While the Company strives for accuracy, prices may be subject to correction in the event of:

  1. a)Typographical errors;
  2. b)Exchange rate fluctuations;
  3. c)Supplier price changes; or
  4. d)Sudden changes in government taxes and Park Entry Fees.

The Company reserves the right to revise pricing prior to confirmation, with full transparency to the Client.

In such cases, any payments made will be fully refunded.

The remaining 70% balance is payable no later than 30 days before the scheduled departure date. For bookings made within 30 days of departure, full payment may be required at the time of confirmation. In the spirit of Ubuntu, Maka-Laskas Adventures is committed to financial transparency. All payments are managed under professional financial controls and are used solely to secure and deliver the specific travel services agreed upon. We respect the trust you place in us and handle your funds with the highest level of accountability.

3. Cancellations & Refunds

If the Client wishes to cancel a confirmed booking, the cancellation must be submitted in writing to operations@makalaskasadventures.com. 17.Permit & Special Supplier Exception

Certain travel components may be subject to cancellation and refund conditions imposed by Regional Authorities, National Wildlife and Primate Permit authorities, or third-party suppliers and their cancellation policies. This may include gorilla and chimpanzee permits, accommodation, national park fees, flights, vehicle services, private charters, activities, and other prepaid arrangements.

Where Maka-Laskas Adventures successfully recovers an amount from a permit authority or supplier following a cancellation, the recoverable amount will be passed to the Client, less applicable administrative, transaction, or recovery costs, where permitted.

Where a supplier’s cancellation conditions are stricter than the standard Maka-Laskas Adventures cancellation schedule, the non-refundable amount actually incurred or retained by that supplier may be deducted from any refund otherwise due.

18.Cancellations by Maka-Laskas Adventures

Maka-Laskas Adventures reserves the right to cancel, postpone, modify, or suspend a confirmed journey where this becomes necessary because of Force Majeure, safety concerns, government restrictions, destination conditions, or circumstances beyond the Company’s reasonable control.

Where appropriate, the Client may be offered one of the following resolutions:

19.Company Cancellation Resolution Options

Resolution OptionApplicable Treatment
RefundRefund of applicable recoverable amounts, subject to supplier conditions
Transfer / PostponementTransfer of the booking to an alternative future travel date, subject to availability
Travel Credit VoucherTravel Credit valid for 12–24 months, subject to the terms issued with the voucher

Where the cancellation arises from circumstances beyond the Company’s reasonable control, the available resolution will depend on the amounts recoverable from suppliers, the nature of the disruption, and the circumstances affecting the journey.

20.Service Disruptions & Third-Party Failures

Where a confirmed service becomes unavailable due to circumstances within Maka-Laskas Adventures’ reasonable control, the Company will, where reasonably possible, provide a suitable substitute of equal or higher standard or provide a proportionate refund for the affected service where no suitable alternative can reasonably be provided.

Where a service failure arises from an independent third-party supplier, including airlines, hotels, lodges, vehicle operators, activity providers, or other service providers, Maka-Laskas Adventures will not be responsible for the supplier’s failure beyond its reasonable contractual obligations. However, consistent with our Ubuntu Tourism philosophy, we will make reasonable efforts to assist the Client in communicating with the supplier and pursuing any refund, compensation, rebooking, or alternative remedy available under the supplier’s applicable conditions.

21.Mandatory Travel Insurance

Comprehensive travel insurance is mandatory for all Clients. The insurance policy should provide appropriate protection for trip cancellation and interruption, medical emergencies, emergency evacuation, personal belongings, travel delays, and other significant risks relevant to the Client’s journey.

Maka-Laskas Adventures shall not be responsible for losses or expenses that are reasonably insurable under an appropriate travel insurance policy where the Client has failed to obtain adequate coverage.

22.No-Show & Unused Services

Failure to arrive at the designated departure point at the scheduled time without prior written notice shall constitute a No-Show and shall result in 100% forfeiture of all amounts paid.

No refund or credit will be provided for services voluntarily unused or declined after commencement of the journey, including accommodation, meals, activities, excursions, transportation, or other itinerary components. Early departure does not entitle the Client to a refund for unused services.

23.Refund Processing

Where a refund has been approved, Maka-Laskas Adventures will process the applicable refund within 30 days of confirmation of the refundable amount and receipt of any information reasonably required to process the refund.

Refunds will normally be made using the original payment method. International bank charges, intermediary bank fees, payment-processing charges, and currency-conversion losses incurred during the refund process may be deducted from the refundable amount.

24.Force Majeure & Ubuntu Fairness Principle

Where a journey is affected by circumstances beyond the reasonable control of Maka-Laskas Adventures, including natural disasters, extreme weather, pandemics or public-health emergencies, political unrest, civil disturbances, government restrictions, border closures, strikes, major transportation disruptions, or other extraordinary circumstances, the Company’s obligations shall be subject to the applicable Force Majeure provisions of these Terms & Conditions.

Consistent with the Ubuntu Tourism philosophy, “I am because we are”, Maka-Laskas Adventures will seek to work with clients, suppliers, authorities, and local partners to identify a fair, practical, and responsible solution. Where commercially and operationally feasible, priority may be given to rescheduling or Travel Credit in order to preserve the value of the journey and support the continuity of local tourism communities and partners.

Where circumstances reasonably justify it, Maka-Laskas Adventures may, at its discretion, consider goodwill arrangements or exceptional solutions beyond its strict contractual obligations, taking into account the individual circumstances of the Client, supplier recoveries, operational realities, and the sustainability of our local partners. Any such goodwill arrangement shall not constitute a waiver of these Terms & Conditions or establish a precedent for future bookings.

4. Flight & Air Travel Protocols

25.Role of Maka-Laskas Adventures as an Agent

Maka-Laskas Adventures Company Ltd acts solely as a booking agent for international and domestic carriers. The Company does not operate, own or manage any aircraft. All travel is subject to the conditions of carriage of the respective airlines and is governed by international treaties, specifically the Montreal Convention (1999) or the Warsaw Convention, which strictly limit the carrier’s liability for delays, injury or baggage loss. The Client engages the Company to assist in booking, planning and scheduling. The contract for air travel remains between the Client and the airline, not the Company.

26.Limitation of Liability for Air Travel

The Company shall not be held liable for any injury, loss, claim, damage or expense arising from airline-initiated operational actions, including but not limited to:

  1. a)Flight delays, cancellations, rerouting, schedule changes, or overbookings.
  2. b)Lost, stolen, or damaged baggage.
  3. c)Denied boarding incidents; strikes, labor disruptions, or technical or mechanical failures.
  4. d)Schedule changes or missed connections.
  5. e)Baggage and Personal Effects: Any claims for lost, stolen, or damaged baggage must be filed by the Client directly with the airline at the airport of arrival before clearing customs.

27.Pricing, Taxes & Ticketing

  1. a)Flight prices are not guaranteed until the full ticket cost is cleared and the electronic ticket (e-ticket) is issued. Any sudden increase in fuel surcharges or government-imposed Airport Taxes after booking but before issuance shall be borne by the Client.
  2. b)The Client is solely responsible for ensuring the name provided at booking matches their passport exactly. The Company is not liable for boarding denials due to name errors or invalid visa/passport documentation. Any fees raised for “Name Correction” due to Client error shall be paid by the Client.

28.Flight Changes and Amendments

Any request by the Client to change flight dates, routes, or cabin classes after the issuance of the e-ticket is subject to the specific fare rules. Unless otherwise agreed, the Company may assist in processing these amendments where applicable. The Client shall be solely responsible for:

  1. a)All airline-imposed change fees or fare differences; and
  2. b)A nominal Company Administration Fee for the labor involved in re-ticketing.

Maka-Laskas Adventures provides no guarantee that requested changes can be fulfilled, as all modifications are strictly subject to the real-time availability dictated by the airline’s global distribution system.

29.Flight Disruptions & Missed Connections

  1. a)In the event of a flight disruption (e.g., delay, cancellation, or rerouting), the Client acknowledges that their primary and financial remedies (such as meals or hotels) are limited to those offered by the operating air carrier under international aviation law.
  2. b)Should an airline disruption result in a late arrival, the Company will make reasonable efforts to adjust the ground itinerary. However, no refunds shall be rendered for missed tour activities, lodge nights, or activities (e.g., Gorilla Trekking) caused by airline failure.
  3. c)Any additional costs incurred to “catch up” with the original tour (e.g., private airport transfers or additional overnight stays) must be settled by the Client and subsequently claimed through their travel insurance.

30.Optional Travel Protection & Insurance

While the Company facilitates booking, it is a strict requirement that Clients possess comprehensive travel insurance that explicitly covers Flight Interruption and Missed Connections. Such protection should ideally cover:

  1. a)Non-refunded tour costs lost due to airline delays;
  2. b)Emergency accommodation and meals during extended layovers; and
  3. c)The cost of “last-minute” replacement flights if a carrier ceases operation.

By declining comprehensive flight protection, the Client formally waives any right to seek financial restitution from Maka-Laskas Adventures Company Ltd for losses arising from airline-related failure.

31.Maka-Laskas’ Ubuntu Service Commitment

While we cannot control airline operations, Maka-Laskas Adventures remains committed to our Ubuntu approach of care. In the event of a disruption, we will provide reasonable administrative support to help you rebook connections, adjust your ground itinerary, and minimize stress, ensuring you feel supported throughout the journey.

5. Travel Documentation, Visas & Health

32.Multi-Jurisdictional Documentation

The Client is solely responsible for obtaining and maintaining valid travel documentation for all countries in the itinerary. Passports must be valid for at least six (6) months beyond the final date of travel and contain sufficient blank pages for each country visited. The Client must secure all required visas, including regional immigration and cross-border documentation such as the East Africa Tourist Visa, prior to departure. No visas are issued on arrival in Uganda or in other regions.

33.Regional Health & Immunization Requirements

  1. a)The Client must comply with all specific health regulations of each destination country. This includes, but is not limited to, the mandatory Yellow Fever Vaccination certificate required for all travelers aged one (1) year and above, and any public health protocols (e.g., Mpox, Ebola, or COVID-19 compliance) in force at the time of travel. While there are currently no mandatory COVID-19 requirements as of 2026, the Company is not liable for costs or cancellations if such protocols are reinstated by government mandate.
  2. b)Failure to present original, valid health documentation at a border crossing is at the Client’s sole risk; no refunds are provided for missed tour services due to entry denial.

34.Cross-Border Transit, Customs & Specialized Equipment

  1. a)Clients must comply with the customs and importation laws of every destination country in the itinerary (including Uganda, Kenya, Tanzania, Rwanda, and the DRC).
  2. b)The importation of specialized equipment, including but not limited to Drones, Satellite Phones, or High-Magnification Photography Gear, is subject to strict local regulations.
  3. c)The Client is solely responsible for securing all necessary permits (e.g., from the Uganda Civil Aviation Authority, Kenya Civil Aviation Authority, or Rwanda Special Permit Office) prior to arrival.
  4. d)The Company is not liable for the seizure of equipment, fines, or delays caused by the unauthorized carriage of such items across any international border.
  5. e)Clients must adhere to regional bans on Single-Use Plastic Bags, which are strictly enforced at border points in Rwanda, Kenya, and Tanzania.
  6. f)Border Delays: While the Company coordinates logistics, the Company shall not be held liable for delays at international borders caused by government processing time, security, or political closure.

35.Ubuntu Cross-Border Support

In alignment with our philosophy of shared responsibility, Maka-Laskas Adventures Company Ltd commits to:

  • Providing general guidance and assistance on visa and health requirements.
  • Utilizing our local network to assist with border navigation.
  • Providing reasonable assistance if document issues arise on the ground, subject to the Client covering any resulting costs.

6. Baggage, Equipment & Personal Property

36.Client’s Sole Responsibility

The carriage and storage of all baggage and personal effects are at the Client’s sole risk at all times. The Company does not accept liability for any loss, theft, or damage to baggage or personal property, regardless of how it occurs, including during transit, in vehicles, or at Third-Party Supplier accommodations.

37.Luggage Restrictions (The “Soft Bag” Rule)

For safety and space reasons in safari vehicles and Regional Bush Flights, only soft-sided bags (duffel bags) are permitted. Hard-shell suitcases with rigid frames or fixed wheels are often impossible to fit in small aircraft pods or vehicle racks and may be refused.

  1. a)Total baggage is typically limited to 15kg (33lbs) per person, including hand luggage, unless otherwise stated in your specific itinerary.
  2. b)Any costs for transporting excess or oversized luggage (including storing it or sending it by separate vehicle) shall be the sole financial responsibility of the Client.

38.High-Value Items & Electronics

  1. a)Clients are strongly advised not to pack jewelry, large amounts of cash, or critical electronics in checked luggage.
  2. b)The Company is not liable for damage to cameras, drones, laptops, or binoculars caused by the dust, heat, or vibrations inherent in African road travel.
  3. c)While many lodges provide in-room safes, the Company is not liable for items stolen from these facilities.

39.Lost or Delayed Baggage

In the event that an airline loses or delays a Client’s luggage, the Company will provide reasonable Ubuntu-led assistance to help track the bags or facilitate their delivery to the tour group. However, any costs for courier services or “emergency clothing” purchases must be covered by the Client or their Travel Insurance.

40.Abandoned Property

Any items left behind by the Client at the end of the tour will be held for 30 days. If the Client wishes to have the items shipped internationally, they must cover all shipping, customs, and administrative costs upfront. After 30 days, unclaimed items may be donated to local community projects in alignment with our Ubuntu values.

7. Medical Disclosure & Physical Fitness

41.Mandatory Medical Disclosure

  1. a)At the time of booking, the traveler must disclose any pre-existing medical conditions, allergies, dietary restrictions, or mobility limitations.
  2. b)Should the Client’s health status change between the booking date (e.g., 12-OCT-2026) and the date of departure (18-MAR-2027), they are contractually obligated to inform the Company immediately.
  3. c)Failure to disclose relevant health information may result in the immediate denial of participation in specific activities (e.g., high-altitude trekking). In such cases, the Company shall not be liable for any refund or compensation.

42.High-Intensity Activity Clearance

To ensure the safety of the group and the protection of wildlife, the Client acknowledges that Gorilla and Chimpanzee Trekking, Mountain Climbing, and White-water Rafting involve strenuous physical exertion in humid, high-altitude, and uneven forest terrain.

43.Right to Refuse Participation

The Company’s tour leaders, guides and National Wildlife Authority rangers reserve the absolute right to disqualify a traveler from a trek if the traveler:

  • Has a physical or mental condition deemed a risk to themselves, the staff, or the endangered primates;
  • Exhibits symptoms of a communicable illness (especially critical for Primate Trekking); or
  • Behaves in a way that endangers safety protocols.

No refund shall be rendered for such disqualification, though reasonable efforts will be made to provide a low-intensity alternative.

44.Medical Certification & Age

For travelers over the age of 65 or those with disclosed mobility issues, the Company reserves the right to request a formal Medical Fitness Certificate from a licensed physician, to be provided no later than sixty (60) days prior to departure. By participating, the Client confirms that they are in good health and possess the physical fitness required for the specific itinerary. Clients must comply with the instructions of the Company’s tour leaders and guides, safety protocols, and regulations. Failure to follow instructions may result in termination of activity participation without compensation.

Liability for Health-Related Disruption: If a traveler is unable to complete a trek or any portion of the itinerary due to lack of fitness, injury, or illness, no refund or credit shall be rendered for unused services or permits.

45.Insurance & Emergency Evacuation

Travelers are strongly encouraged to have comprehensive travel insurance for all high-intensity activities. This insurance must include Emergency Medical Evacuation to a suitable medical facility and trip cancellation due to health issues, as many destinations are extremely remote.

46.Maka-Laskas Ubuntu Care Commitment

In alignment with our Ubuntu values, Maka-Laskas Adventures prioritizes your wellness above all else. We do not view medical disclosures as a barrier to travel, but as a way to ensure we can provide the care and support necessary for an inclusive and safe experience. In the event of an on-tour medical incident, we commit to standing by you as “family,” coordinating all necessary support with compassion and transparency.

8. Accommodation Standards & Substitutions

47.Selection & Accommodation Standards

The Client acknowledges that standards and expectations vary significantly across international borders, and between urban centers and remote safari regions. The Company commits to providing accommodation that meets safety, hygiene, and comfort levels consistent with the “Star Rating” or “Category” (Budget, Mid-range, or Luxury; Essence, Roots, Legacy, or Bespoke) specified in the itinerary.

48.Substitution Policy & Overbookings

  1. a)In the event of third-party overbooking, operational failure, safety concerns, or Force Majeure, the Company reserves the right to substitute any specified accommodation.
  2. b)Substituted accommodation will be of an equal or higher standard than originally booked. If a substitute of an equal or higher standard is provided, no refund or compensation will be provided. In the rare event that only a lower-standard substitute is available, the Company will refund the price difference to the Client.

49.Client Conduct & Property Damage

Clients must adhere to the specific rules of each lodge or hotel. The Client is personally and financially responsible for any damage caused to hotel property, vehicles, furniture, or equipment during their stay. Such charges must be settled directly with the accommodation provider before checkout.

50.Limitation of Liability for Independent Third-Party Suppliers

All lodges, camps and hotels are independent Third-Party Suppliers and are not owned, managed, or controlled by the Company. In accordance with Section 3, the Company shall not be held liable for any injury or dissatisfaction resulting from the acts, omissions, or service failures of these independent suppliers, including:

  • Temporary internal utility outages (e.g., plumbing, electricity, or Wi-Fi disruptions) in remote wilderness environments;
  • Theft or loss of personal items from rooms or safes;
  • Maintenance issues or temporary facility closures;
  • The specific conduct or negligence of lodge personnel; or
  • Variations in room decor or view from marketing photographs.

51.Special Requests & Upgrades

Requests for specific room numbers, bed configurations (Twin vs. Double), or dietary-specific meal plans are subject to availability and the lodge’s internal management policies. While the Company will advocate for these requests, they are not guaranteed unless confirmed in writing and paid for as an “Upgrade.”

52.The Maka-Laskas Ubuntu Hospitality Commitment

In line with our Ubuntu philosophy, we carefully select partners who demonstrate ethical labor practices and support their local communities. We prioritize lodges that offer an authentic cultural connection, ensuring your stay contributes to the sustainable development of the region while providing a safe and welcoming “home away from home.”

9. Your Responsibilities & Conduct as a Traveler

53.Compliance with Local Laws & Customs

Travelers must strictly comply with the national laws, customs, and regulations of all countries visited in the itinerary (including Uganda, Kenya, Tanzania, Rwanda, and the DRC). Illegal acts by travelers (e.g., drug possession, unauthorized use of drones, or unauthorized photography of government buildings) will result in immediate termination of service without a refund.

54.Adherence to Safety Protocols

The safety of the group and the protection of wildlife are paramount. Clients must respect and follow all instructions provided by Company private guides/tour leaders and National Wildlife Rangers at all times. Any behavior that endangers the traveler, the group, or the staff will result in immediate removal from the activity or the termination of the entire tour at the Client’s sole expense.

55.Environmental & Wildlife Stewardship

Maka-Laskas Adventures maintains a zero-tolerance policy regarding environmental damage. Travelers must not harm, feed, or disturb any wild animals. Littering or damage to ecosystems is strictly prohibited. Travelers must strictly adhere to distance protocols set by rangers (e.g., UWA/RDB) during Gorilla and Chimpanzee tracking. Violation of these rules or park rules may result in legal action by wildlife authorities or immediate removal from the park.

56.Ubuntu Ethical Conduct & Community Respect

In alignment with our Ubuntu Tourism philosophy, all travelers must engage with local residents with respect and empathy. Travelers must respect local dress codes, traditions, and the sanctity of cultural heritage sites, and must seek permission before taking photographs of local people. Behavior that is offensive, exploitative, or disruptive to local communities may result in immediate termination of service.

57.Group Dynamics & Lead Client Responsibility

For group bookings, the Lead Client is responsible for ensuring all members are aware of and comply with these conduct expectations. The Company is not liable for the independent actions of, or damages caused by, individual group members.

58.Specialized Equipment & Drone Regulations

  1. a)The use of Unmanned Aircraft Systems (Drones) is strictly regulated across East Africa.
  2. b)Travelers may only operate drones if they possess valid permits from the relevant civil aviation authority (e.g., UCAA in Uganda) and have received written permission from the Company.
  3. c)Flying drones in National Parks or over sensitive security areas without explicit government authorization is strictly forbidden.
  4. d)Any professional filming or photography for commercial purposes requires separate Filming Permits and prior approval from the Company.

59.Marketing & Media (Photography Release)

  1. a)The Client acknowledges that Company representatives may take photographs or videos during the tour for promotional and marketing purposes.
  2. b)By participating, the Client grants the Company a perpetual, royalty-free license to use their likeness in such media.
  3. c)Opt-Out: If a Client does not wish to be photographed, they must notify the Company in writing prior to the tour start.
  4. d)In line with our Ubuntu values, we commit to using all media respectfully, ensuring the dignity and privacy of our Clients and local communities.

60.Right to Terminate for Misconduct

The Company reserves the right, at its sole discretion, to terminate the services or itinerary of any traveler whose behavior violates these Terms and the Ubuntu principles, threatens the safety of staff, or disrupts the group or the integrity of the travel experience.

In the event of termination for misconduct, the Company’s responsibility toward the Client ceases immediately. No refund will be issued for any unused portion of the tour. The Client remains responsible for all costs associated with their return travel.

61.The Maka-Laskas Ubuntu Commitment

We invite our travelers to be more than just “tourists”; we encourage you to be Global Citizens. By embracing the spirit of Ubuntu, recognizing that “I am because we are”, you help us foster meaningful connections and ensure your journey leaves a lasting, positive impact on the land and people of Africa.

10. Special Traveler Categories

62.Young Explorers (Minors under 18)

  1. a)Clients under the age of 18 years are considered minors (Young Explorers).
  2. b)Children must be accompanied by a parent, legal guardian, or authorized adult at all times during travel and activities. The Company is not a childcare provider and does not accept “unaccompanied minor” status for tours.
  3. c)Certain activities have strict legal age limits (e.g., gorilla trekking in Uganda and Rwanda, white-water rafting, and mountain climbing) and may currently require participants to be at least 15 years old or to have medical clearance.
  4. d)Parents/guardians assume full responsibility for their children’s safety, conduct, and compliance with Company rules.
  5. e)Minors must possess valid passports, visas, unabridged birth certificates, and any notarized consent letters or documentation required for travel under regional immigration laws.

63.Group Bookings (6+ Travelers)

  1. a)Any booking involving six (6) or more Clients qualifies as a group. Lead Client Responsibility: The Lead Client or designated Group Leader making the booking is responsible for ensuring all group members read, understand, and sign these Terms & Conditions.
  2. b)The Lead Client must collect and submit all medical disclosures and insurance details for the entire group no later than 45 days before departure. The Lead Client supervises behavior, safety, and adherence to Ubuntu Tourism principles and Company rules.
  3. c)Group Booking Benefits: Groups may qualify for special rates, itinerary adjustments, or additional logistical support. Group cancellations follow the cancellation policy but may require special handling due to supplier commitments.
  4. d)Note: Any cancellation by a group member that reduces the total group size may result in a price increase for the remaining travelers to cover shared costs (e.g., vehicle hire).

64.Students & Educational Groups

To qualify for Student Rates, travelers must provide a valid International Student Identity Card (ISIC), Student Identity Card (SIC), or an official letter from their institution at the time of booking. Students are expected to follow all Terms & Conditions and uphold Ubuntu Tourism principles, showing respect for local cultures, environmental conservation, and academic discipline during field trips.

65.Insurance Requirements for Special Categories

Children, minors, students, and groups participating in high-risk activities must have comprehensive travel insurance covering emergency medical evacuation and activity-related incidents. Groups must ensure that all participants are adequately insured prior to departure.

66.Maka-Laskas’ Ubuntu Duty of Care

In line with our Ubuntu philosophy, we treat every “Young Explorer,” “Student,” and “Group” with the care of an extended family. While legal responsibility for compliance, safety, and conduct remains with the Clients (parents, guardians, group leaders, or students themselves), Maka-Laskas Adventures commits to providing guidance, supervision, support, and deep cultural and environmental context to foster global citizenship, and to implementing enhanced safety checks for family-friendly and student-led itineraries.

11. Risk, Liability & Indemnity

67.Acknowledgment of Inherent Risk

The Client acknowledges that adventure travel, safaris, and Wildlife Encounters involve inherent risks that cannot be entirely eliminated. These include, but are not limited to:

  1. a)Unpredictable behavior of, and interactions with, wild animals in their natural habitat;
  2. b)Travel over rough, unpaved terrain and unpredictable road conditions;
  3. c)Remote locations with limited access to modern medical facilities; and
  4. d)Strenuous activities (e.g., Mountain Climbing or Primate Trekking).

By booking, the Client voluntarily assumes these risks as part of the authentic African experience.

68.Limitation of Liability (The Financial Cap)

To the fullest extent permitted by law, the Company’s total aggregate liability for any claim (excluding death or personal injury caused by proven gross negligence) is strictly limited to the total amount paid by the Client for the affected booking. The Company is not liable for:

70.High-Risk Activity Clause

For activities classified as high-risk (e.g., Hiking, White-water Rafting, Bungee Jumping, or Gorilla Trekking), the Client acknowledges they are choosing to participate in a high-risk environment. The Company acts only as a facilitator for these specialized activities, and the specific liability waivers of the activity provider shall take precedence.

13. Financial Protection & Integrity

77.Financial Protection Mechanisms

To ensure peace of mind and align with global consumer protection benchmarks, Client funds are protected against Company insolvency through a dedicated trust account or indemnity insurance.

Client prepayments are held in a segregated account, strictly separated from the Company’s daily operational funds.

Funds are released from the protected account only to fulfil specific itinerary obligations (e.g., non-refundable trekking permits and lodge deposits) or upon the successful completion of the tour.

78.Client Rights in Insolvency

In the unlikely event of financial disruption or insolvency, the Client is entitled to a full reimbursement for any unprovided services, managed through the active protection mechanism.

79.Transparency & Verification

The specific protection method applicable to a booking will be clearly indicated on the Booking Confirmation and is available on the Company website.

Clients are encouraged to verify the standing of our financial protections as part of our commitment to transparency and their pre-travel due diligence.

The Company ensures that payments to local suppliers and communities are handled with integrity, maintaining the financial health of the regional tourism ecosystem.

In line with Ubuntu principles, we believe that financial stewardship is a sacred trust. Protecting your investment is an act of shared responsibility that ensures fairness and long-term sustainability for our Clients, our staff, and the local communities we support.
